Facts of the Case:

  • The petitioner in this case had filed a writ petition seeking the Hon’ble court to issue a writ/ order or direction in the nature if certiorari / mandamus or any other appropriate writ or direction to set aside or quash the decision of considering the tender construction of Doordarshan Bhawan , New Delhi.
  • While considering the disposal of the Writ Petition No 3426/ 1994 the Hon’ble Coury held that as the Petitioners are not marked blacklisted it is unfair to deprive their right of particupation in the tender proceedings.
  • However, it is observed the Respondents passed order banning the Petitioner on grounds of malpractice and dissemenating false information.
  • Respondents issued show cause notice to petitioner and the petitioner filed their reply to the same.
  • The Respondents after considering the reply from Petitoner passed final order of banning Petitioner and its allied firms and partners in business from dealing with the Ministry of Information anf Broadcasting and subordinate offices for period of 10 years

The Hon’ble Supreme Court Observed and Held as Follows:

  • The Hon’ble court observed that the Petitioner is not black listed and therefore could participate in tender proceedings.
  • In view of the principles laid down by Supreme Court abd also in view of subsequent events that have taken place that Petitioner was debarred .
  • Further considering the Public interest involved in this case as the present contract relates to important construction work namely Mandi House Phase II the present writ petition dismissed .
  • The parties to bear their own cost
